These are the laws that deal with the regulation of telecoms in Jersey and Guernsey


Telecoms Laws



Spectrum Law

The JCRA and the GCRA have authority to issue telecommunications licenses under the respective telecommunications laws in place in both Islands. However, telecommunications operators that require wireless frequency spectrum to operate their existing or proposed services will require separate spectrum licenses.

Wireless Telegraphy licenses to utilise spectrum in Guernsey and Jersey are issued by the UK communications authority, Ofcom, under the Wireless Telegraphy Act 2006 and the Communications Act 2003 (as extended to the islands). Ofcom manages spectrum and international coordination on behalf of the Channel Islands.

Operators and potential operators of telecommunications should nevertheless contact either the GCRA or the JCRA in the first instance in order to verify the requirements under the law. It is intended that where possible spectrum licensing will be dealt with on a pan-Channel Island basis.



JT Condition 33

Jersey - JT Condition 33

Condition 33 of JT (Jersey) Limited's (“JT”) Licence applies to price regulated services and requires JT to notify the public when it introduces new prices for existing services or prices for new services, discounts to established prices or special offers at least twenty one (21) days prior to their coming into effect and provide full details to the JCRA.

The JCRA may determine the maximum prices that can be charged in markets where JT is dominant.

Guernsey - Condition 31

Condition 31 of JT (Guernsey) Limited's (“JT”) Licence applies to price regulated services and requires JT to notify the public when it introduces new prices for existing services or prices for new services, discounts to established prices or special offers at least twenty one (21) days prior to their coming into effect and provide full details to the GCRA.

The GCRA may determine the maximum prices that can be charged in markets where JT is dominant.
